MIKUNI AT NORTHSTAR GETAWAY OFFICIAL RULES
Participation. NO PURCHASE IS NECESSARY. Each applicant who enters the Mikuni at Northstar Getaway (“Northstar Getaway”) will be deemed a Participant subject to restrictions. On each Friday beginning January 7 through February 10, 2011, Mikuni shall select one Participant to become a Finalist. Each Finalist will be notified by mail or in person at our option. Once you have been selected as a Finalist, you are no longer eligible to become another Finalist. You must be 21 years old at the time you are selected as a Finalist. Mikuni affiliates, sponsors, principals and employees, and their immediate family members (father, mother, children and siblings), are not eligible to participate. This Northstar Getaway is void where prohibited by law. All federal, state and local laws apply.
Entries. If you are a Koki Club member, you are automatically entered for a chance to win the Northstar Getaway. In addition, each time you use your Koki Club card you further increase your chance to win the Northstar Getaway. You obtain your Koki Club card by completing an application and submitting it to any one of our restaurant locations. You must be a Koki Club member by 9:00 P.M., Sacramento Time, on February 10, 2011 to be eligible to be selected as a Finalist.
The Winner Will Be Selected As Follows. The Northstar Getaway event will be held at noon on Tuesday, February 15, 2011, at our Midtown restaurant located at 1530 J Street, Sacramento, CA. There will be five Finalists. At the event, each Finalist will be given a key. Only one key will open the grand prize of the Northstar Getaway and the holder of such key will be deemed the winner. If you are selected as a Finalist, you must attend, or your representative must attend, the Event in order to receive a key. You must notify us 48 hours prior to the event if your representative will be attending. If neither you nor your representative can attend, Mikuni will select a new Finalist. Each Finalist must sign an Affidavit of Eligibility within 7 days of selection or we will select an alternate Finalist. Acceptance of becoming a Finalist constitutes permission to use the Finalist’s name and photograph in website promotions, and for other promotional purposes, unless prohibited by law.
Odds. There is only one Northstar Getaway package that will be given away. The odds of becoming a Finalist and obtaining the winning key to win the Northstar Getaway depends on the number of Koki Club members and usage of their Koki Club card.
Taxes and Charges. All Finalists are responsible for all applicable taxes (whether local, state, or federal), surcharges, tariffs, duties, shipping and handling charges, and all other charges associated with taking possession of any prize. The winning Finalist is also responsible for travel to Northstar At Tahoe to utilize the prize.
Mikuni’s Decision Is Final. By entering this Northstar Getaway, each Participant accepts and agrees to be bound by these official rules and the decisions of Mikuni. Mikuni is not responsible for any incorrect or inaccurate information caused by any technical or human error which may occur in the processing of entries in the Northstar Getaway. Mikuni assumes no responsibility for any error, omission, defect, theft or destruction or unauthorized access to, or alteration of entries. Mikuni is not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or combination thereof, including injury or damage to Participants or to any other person’s computer related to or resulting from downloading materials in this Northstar Getaway.
Warranty: Neither Mikuni nor its affiliates, sponsors, employees, agents or agencies assume any responsibility for damages, losses, or injury resulting from receiving and using any of the prize including use of the lift tickets at Northstar and related activities. MIKUNI AND ITS AFFILIATES, SPONSORS, EMPLOYEES, AGENCIES AND AGENTS EXPRESSLY EXCLUDE ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES OFFERED BY MIKUNI, AND ITS AFFILIATES, SPONSORS, EMPLOYEES, AGENCIES OR AGENTS WHICH EXTEND BEYOND THE DESCRIPTION ON THE FACE HEREOF.
Release: By participating in this Northstar Getaway and/or accepting a prize, a Participant agrees to defend, release and hold harmless Mikuni and its affiliates and sponsors, their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, employees, representatives, and agents (collectively “Releasees”) from and against any actions, claims and/or liability for injury, loss or damage of any kind (including any for the violation or infringement of any proprietary or personal right of any individual or entity) resulting in whole or in part, directly or indirectly, from participation in this Northstar Getaway, and/or the use, acceptance, or possession of a prize, and/or participation in a prize-related activity. By participating in this Northstar Getaway and/or accepting a prize, a Participant consents to and gives Mikuni’s the right to use a Participant’s name, address and entry form information; to interview, audio tape, photograph, and video a winner (with prize where applicable), and in perpetuity to use a Finalist’s statements, quotes, picture, portrait, likeness, voice, video, biographical information, prize information, and descriptive information (in whole or in part, as may be adapted, edited, or modified, as solely determined by Mikuni) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without additional consideration, unless prohibited by law.
